Avenga Information Clause
In accordance with Article 13 ( 1 ) and ( 2 ) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter: GDPR) (Journal of Laws of the Republic of Poland). UE L 119/1), we hereby inform you that:
1. Your personal data for recruitment process are processed in accordance with Joint Controlling agreement signed by a number of legal entities within the Avenga Group – the list of the companies is available under following link.
2. The Lead Controller of your personal data is Avenga Germany with the registered office Avenga Germany GmbH, Bahnhofsvorplatz 1, 50667 Cologne, Germany, Commercial register: AG Köln, HRB 79823
3. Your personal data will be processed in accordance with the GDPR in order to:
a. implementation of current recruitment processes in the scope of data contained in the CV. Article 6( 1 )(a) GDPR,
b. conducting future recruitment processes, based on consent - Article 6( 1 )(a) of the GDPR,
c. to pursue legitimate interests pursued by the Lead Controller and the joint controllers - Article 6( 1 )(f) of the GDPR - to match the offer in accordance with the candidate's profile, to determine, defend or pursue possible claims and to protect persons and property belonging to the Controller.
4. Use of AI Features
As part of our recruitment process, we may use AI-enabled features provided by our recruitment platform to support administrative and organizational activities. These features are not used for profiling candidates or for solely automated decision-making. Each of our decisions is based on human actions.
The use of the AI features is based on our legitimate interest in ensuring an efficient recruitment process. Prior to their implementation, an appropriate legal and privacy assessment was conducted, and technical and organizational measures have been put in place to ensure their compliant and responsible use.
During the recruitment process, we collect and process personal data provided directly by candidates, obtained from publicly available professional sources such as LinkedIn, and generated throughout the recruitment process, including during interviews and communications with candidates.
5. Background Checks
If you receive an offer from us, we may conduct a background check where this is required for the specific role and based on the applicable risk level associated with the position. The purpose of such checks is to verify information relevant to your application and ensure that role-specific requirements are met.
To the extent permitted by applicable law, we may collect and verify relevant personal data as part of the background check process. The type and scope of checks performed may vary depending on the role, applicable legal requirements, and local practices.
We may collect relevant personal data from appropriate sources, including information provided directly by you, employment background check providers, or other authorised third parties involved in the verification process.
Where required, you will be informed about the background check process before screening takes place. Depending on the nature of the engagement and applicable legal requirements, we may rely on information provided through the recruitment process or obtain additional authorisations, acknowledgements, or consent as necessary.
We may also collect personal data that you have chosen to make publicly available on professional social media websites where relevant for the recruitment process and limited to publicly available professional information.
Any information collected as part of the background check process will be handled confidentially, accessed only by authorised persons, and retained in accordance with applicable data retention requirements.

7. Personal data for which consent has been given for processing in the current recruitment processes point 2 a) will be processed until the completion of the processes - no longer than 6 months. Personal data to which consent has been given in point. 2 b) and c) will be processed until the purpose of their processing is fulfilled or until you withdraw your consent and actively object to the processing for this purpose.
8. The Lead Controller has the right to transfer your personal data to entities authorized under the provisions of law and to processors with whom it has concluded a joint controller agreement and data processing agreements.
9. Your personal data may be transferred outside the EU/EEA area. The data will be duly protected on the basis of appropriate safeguards under Chapter V of the GDPR, including, where applicable, accepted standard contractual clauses guaranteeing the protection of individuals.
10. You have the right to request access to personal data, their rectification, deletion, restriction of processing and portability. The request should be placed on the Lead Controller.
11. You have the right to withdraw your consent at any time by sending a statement to the e-mail address, which does not affect the lawfulness of the processing that was carried out on the basis of the consent before its withdrawal.
12. You have the right to object to the processing indicated in point 2 c) in order to pursue the legitimate interests pursued by the Controllers, but the right to object may not be exercised in the event of justified grounds for processing, overriding your interests, rights and freedoms, in particular the establishment, exercise or defense of claims.
13. Providing personal data is voluntary, and failure to provide them may result in the inability to participate in recruitment processes.
14. Your personal data will not be subject to solely automated decision-making, including profiling, within the meaning of Article 22 GDPR. All recruitment decisions involve human review and assessment.
15. You have the right to lodge a complaint with the competent Supervisory Authority.
